Welcome to CREA! These Terms of Service (“Terms”) govern your access to and use of our platform, including our website, mobile applications, and related services (collectively, the “Services”). By accessing or using CREA, you agree to these Terms.
If you do not agree with these Terms, you must not use our Services.
1. Use of the Services
Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Services.
By using CREA, you represent and warrant that you have the legal right and capacity to agree to these Terms.
Account Registration
To access certain features, you must create an account and provide accurate, complete, and current information.
You may register using your email, phone number, or supported third-party authentication services, including Apple or Google
When using Sign in with Apple, users may choose to keep their email private. CREA only receives the name and an Apple relay email (if enabled) and does not collect any advertising or behavioral data from Apple.
You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.
Permitted Use
You may use the Services only for lawful purposes and in compliance with these Terms.
Prohibited Conduct
You agree not to:
Upload or share harmful, abusive, or illegal content.
Misrepresent your identity or credentials.
Violate any applicable laws or regulations.
Attempt to hack, disrupt, or damage the Services.
2. User Content
Ownership
You retain ownership of any content you upload or create on CREA, such as portfolios, profiles, or projects.
License
By uploading content, you grant CREA a non-exclusive, royalty-free license to use, display, and distribute your content as necessary to operate and improve the Services.
Responsibility
You are solely responsible for the content you upload and for ensuring that it does not infringe upon third-party rights.
3. Privacy
Your use of the Services is also governed by our Privacy Policy, which explains how we collect, store, and use your information.
Data Collection & Use
CREA collects basic personal information (name, email, phone number) to create and manage accounts.
Media files (photos, videos, and audio) are collected only to allow users to upload portfolios and showcase work.
CREA does not track users across other apps or websites, sell personal data, or use collected data for advertising purposes.
Analytics and crash data are collected anonymously to improve performance and reliability.
4. Fees and Payments
Fees
Certain features or services, such as premium plans or subscriptions, may require payment. Fees are clearly displayed before purchase.
Payment Terms
On iOS (Apple devices), all payments and subscriptions are processed securely through Apple’s In-App Purchase (StoreKit) system.
On Android devices, payments are processed securely through Razorpay or Google Play Billing.
CREA does not store or process credit card or banking details directly.
All payments are final and non-refundable except where required by law or explicitly stated otherwise.
Taxes
You are responsible for any applicable taxes associated with your purchases.
Refunds
Refunds for iOS purchases must be requested through Apple Support.
Refunds for Android purchases may be requested by contacting CREA Support at support@creanetwork.in and will be handled in accordance with applicable local laws.
5. Intellectual Property
Ownership
All content and materials provided by CREA, including logos, trademarks, and designs, are owned by Artiztellar Network Pvt. Ltd. or its licensors.
Restrictions
You may not copy, modify, distribute, or create derivative works of CREA’s intellectual property without prior written permission.
6. Termination
By CREA
We may suspend or terminate your account if you violate these Terms or engage in prohibited conduct.
By You
You may terminate your account at any time by contacting connect@creanetwork.in.
Effect of Termination
Upon termination, your right to access the Services will cease immediately, and CREA may delete your content from its systems.
7. Disclaimer of Warranties
CREA provides the Services on an “as is” and “as available” basis without any warranties of any kind, express or implied.
We do not guarantee uninterrupted or error-free service.
8. Limitation of Liability
To the fullest extent permitted by law, CREA and its affiliates shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Services.
9. Indemnification
You agree to indemnify and hold CREA, its affiliates, and employees harmless from any claims, losses, or damages resulting from your use of the Services, your content, or your violation of these Terms.
10. Compliance with App Store and Play Store Policies
CREA complies with all Apple App Store and Google Play Store policies.
Platform-specific features such as Sign in with Apple, Apple’s In-App Purchases, or Google Play Billing are implemented in accordance with each platform’s requirements.
11. Changes to the Terms
CREA may update these Terms from time to time. We will notify users of significant changes and post the updated Terms on our platform. Continued use of the Services after such updates constitutes your acceptance of the revised Terms.
12. Governing Law
These Terms are governed by the laws of Bengaluru, India.
Any disputes shall be resolved exclusively in the courts located in Bengaluru, Karnataka.
